The Federal Court in Melbourne has dismissed the appeal by the eSafety Commissioner, dealing a serious blow to bureaucratic censorship powers.
The case centred on activist Celine Baumgartner, whose video criticised a so-called “Queer Club” for children aged eight to twelve at a Victorian primary school. Instead of debating the issue, the regulator attempted to quietly geoblock and suppress the content.
The court upheld an earlier tribunal ruling that slammed the eSafety Commissioner’s informal and procedurally flawed takedown tactics under the Online Safety Act. Backed by the Free Speech Union, Baumgartner challenged the decision - and won.
⚖️ The ruling sets an important precedent: Ekaren can’t bypass due process to silence lawful speech.
Baumgartner has called the decision a victory not only for free speech, but for parental rights and transparency in education.

❗️Perth court lifts suppression order on identity of man accused of attempted Invasion Day bombing revealing terrorists identity as former One Nation candidate Liam Hall.
Liam Alexander Hall is the first person to be charged with terrorism offences in Western Australia.
About 2,500 people were marching in an "Invasion Day rally" through Perth’s CBD on 26 January when Liam Hall allegedly threw a homemade “fragment bomb”, filled with ball bearings and nails, off a balcony and into the crowd.
The device, which was allegedly designed to explode on impact, did not detonate.
The suppression order was challenged by four media organisations: the ABC, Seven West, Nine and Guardian Australia. Dias said that there were some circumstances where the court may make a suppression order, and this can only occur if there are proper grounds to do so.
Hall was scheduled to appear via video link from prison on Tuesday morning, but did not appear. He is being held on remand charged with engaging in a terrorist act, making or possessing explosives under suspicious circumstances and one count of intent to harm or doing an act which could endanger the life, health or safety of any person.
