🌟Limitation period of writs is not given and the following remarks were made in the judgements under the case:

⚡[Trilok Chand Motichand v. H.B. Munshi]

Sikri, J., opined that three years will be the proper yardstick.

Bachawat, J., put it as one year.

On the other hand, Justice Hegde suggested that the law on limitation has no application under Article 32 and as such the Court cannot refuse a petition based on delay.

✨In this regard, however, Chief Justice Hidayatullah felt that no hard and fast rule should be adopted
1) He stated that the issue should be dealt with by the Court on a case to case basis.
2)The whole issue is dependent on what the breach of a fundamental right is.
3)what the remedy is and why did the delay in question arise in the first place.
This view seems to be the most reasonable in this regard because the matter is best left to the discretion of judges and also because the facts and circumstances of one case are never identical to another.

Basic fundamental rights of individuals and as such needs to be dealt with utmost sensitivity and care.

⚡[Gian Singh v. High Court of Punjab and Haryana

The writ petition was filed by the petitioners eleven ears after the date from which they claimed promotions.

The petitioners argued that during these intervening years they were busy making representations before different authorities regarding their grievances.

✨The Court rejected their contentions stating that there were no valid reasons for justifying the delay of eleven years and therefore their petitions were dismissed.

✍️ Ratio Decidendi:
1. The protection under Article 212(1) operates only with respect to the ‘Proceedings in the Legislature’ on the grounds of ‘Procedural Irregularities’. It could not have been the intent of the lawmakers to circumscribe Constitutional Courts unconditionally from scrutinising the validity of the actions of the Legislature, which may encroach upon the Fundamental Rights of the members and/or citizens.

2. Proceeding in Legislature:
The procedural steps,debates, motions, amendments, discussions and scruitiny which are not end in themselve but measure to reach outcome. [Immune]

3. Legislative Decisions:
Formal expression of will of house on given matter, authoritative decision after procedural ones.

4. Why not immune?
✓ To safeguard and uphold constitution by an action of judicial review.

✓ Interpretation Rule:
Expressio unius est edclusio alterius (express mention of one thing is exclusion of another)
Procedings of legislature on the touchstone of irregularity of procedure is mentioned and immune but legislative decisions are not mentioned hence not immune from judicial review.

✓ If legislature made rules under Article 208 then this disciplinary action amounts to adminstrative action which though by legislature still it is subject to judicial review if it is unconstitutional, grossly illegal or arbitrary.
