In this enshrining of our republican form of gov’t (and right to it) is something called, separation of powers.
From 1963 to 1982 only 2 nationwide injunctions against the Executive were ever issued. Non prior to 1963 to our founding.
Unironically, the spawn of this boon in injunctive lawfare against the Executive was initiated by Democrats:

So, when we math, President Trump’s share of the 126 total injunctions over the past 40 years is 64.3%. I made the staggering visual below for supporting perspective.
Despite Democrat’s “injunctions-because-Nazi” derp, the above reality becomes particularly interesting when factoring President Trump is the most popular president in US history, racking up 214,511,383 total Executive votes.
This, of course, powered by a +17.7% vote gain in 2020, then adding an additional increase of +4.2% on top of that in 2024. This in two elections that stole votes from DJT.
I emphasize this because the other really important thing the Guarantee Clause cements for us in America is popular sovereignty. In this immovable consent of the governed, there is no other position more representative of the will of the people than the Executive.
It’s the only representative power in our entire republican form of gov’t that every, single, American who has not forfeited that right, can vote for.
This week SCOTUS ended the dangerously destructive and highly partisan lawfare of an imploding Democrat party gasping for air, and America’s popular vote is cheering from the roof tops.

SCOTUS has ruled federal district courts cannot issue most nationwide injunctions in the birthright citizenship case. 6-3, ACB writing the majority opinion. A victory for the Administration. But note what they said/what it means:
1. The district courts can issue injunctions that provide nationwide relief to the individual plaintiffs before it, so the decision for those people can’t change if they move, for example.
2. The bar otherwise only applies to district courts, not the courts of appeals or SCOTUS (Kavanaugh makes this point).
3. The case does not say that district courts can’t strike down federal actions on the merits (not TROs or Preliminary Injunctions) which would apply to everyone in their district - whether a plaintiff or not - because a judgement binds the government there. (It can appeal that).
4. ACB specifically drops a footnote that points out that the case does NOT apply to the district courts’ statutory power to vacate federal actions in their entirety under the Administrative Procedure Act (which is a different source of authority from the court’s equitable powers).
5. The case would not apply to class actions. Plaintiffs would have to jump thru all the hoops in Rule 23 to do that. (Alito worries that the district courts will loosely allow classes therefore to get around this case.)
6. The Court did not decide whether states can get nationwide or universal injunctions for their citizens. There was an issue in this case with whether states had standing to be in this case. That will have to be litigated again likely.
7. Kavanaugh points out that the likely effect that this case will have is that the Courts of Appeals and the SCOTUS will have to be more involved in preliminary injunction litigation, but he says they are up for it. (Sure, they are. 🙄)
In sum, this case should prevent the worst, most immediate abuses engaged in by the district court bench in recent years in issuing preliminary injunctions against new govt policies, and it will move the battles procedurally to class actions & up to the appellate levels. So, in theory the injunctions that bind the govt with broad effect should be fewer and better reasoned. We will see.

The specific case involved Jay Aliff, who sued in 2021 over the insurance payout for his house near Lake Tahoe, which was damaged in the November 2020 Mountain View fire. His lawsuit challenged the California Fair Access to Insurance Requirements Plan, or the FAIR Plan, the state’s high-risk insurance pool or the last-resort option for those dropped by private insurance companies.
