Everyone is comparing the Trump flag burning EO with burning a rainbow flag:
"If you can go to jail for burning a rainbow flag, why can't you go to jail for burning a US flag?"
That is a weak analogy and the issue in reality is far more complex.
Allow me to explain.
1. If you BUY a flag--ANY FLAG (U.S., gay rainbow, North Korea, the Dallas Cowboys, Cookie Monster, "Don't Give Up the Ship," Cracker Barrel, does not matter)--and you light it on fire in your backyard, and presuming there is no statute against lighting fires of any kind in your backyard: NOT A CRIME.
2. If you STEAL a flag--ANY FLAG (U.S., gay rainbow, North Korea, the Dallas Cowboys, Cookie Monster, "Don't Give Up the Ship," Cracker Barrel, does not matter)--and you light it on fire anyplace: YES A CRIME.

Pfizer has urged a Florida federal judge to dismiss lawsuits claiming its birth control shot Depo-Provera can cause users to develop a type of brain tumor, saying regulators barred the company from including a warning about the tumors on the drugβs label.
The New York-based pharmaceutical company told U.S. District Judge M. Casey Rodgers in Pensacola in a Friday filing that claims the company failed to warn consumers and physicians about the risk of meningiomas associated with the drug were preempted by the U.S. Food and Drug Administrationβs rejection of that warning before the litigation began. The tumors are often benign but can compress brain tissue and require surgery, the plantiffs said in the court filing.
Instead of following a more typical bellwether process to have both sides select cases to test the claims, the judge selected five so-called "pilot" cases to prepare for trial. Pfizer asked the judge to enter judgment for the company in the five cases.

It does not make the mere act of burning a US flag illegalβthat is still constitutionally protected speech. What it DOES make illegal is this: burning a US flag "in a manner that is likely to incite imminent lawless action or that is an action amounting to βfighting wordsβ.β
So if you want to go burn your own flag in your own backyard, have at it.
But if you want to burn that flag amidst a violent βDeath to Americaβ rally paid for by George Soros, thatβs something altogether different.
Now I am not opining on whether even that narrow interpretation will survive constitutional scrutiny.
But know thisβthe more of these sorts of EOs Trump signs, the more legal resources the Democrats must expend to challenge him, resources that could probably be better deployed (for their purposes) on issues essential to the Trump agenda.

NEWπ₯: Florida is looking into sanctuary jurisdictions that provide commercial driver's licenses to illegal immigrants after an illegal immigrant truck driver allegedly caused a crash that killed three people earlier this month, state Attorney General James Uthmeier told reporters Monday.
Uthmeier spoke to reporters at a press conference alongside other law enforcement officials in response to the Aug. 12 crash involving 28-year-old illegal immigrant Harjinder Singh, and the arrest of another illegal immigrant, identified as Roberto Carlos Vergara, who was driving a commercial vehicle in Bay County on Sunday night.
Illegal immigrants are unable to obtain driverβs licenses in Florida, Uthmeier said, adding that sanctuary states that provide illegal immigrants with the licenses are creating a "major liability."
