🧾 Office of Profit – Explained Simply
🔹 Meaning: Any govt post that gives salary, perks, or financial benefit.
🔹 Why it matters? MPs/MLAs must stay neutral. Holding such posts may create a conflict of interest.
📜 Constitutional Backing:
▪️ Article 102(1)(a) – For MPs
▪️ Article 191(1)(a) – For MLAs
➡️ Disqualifies them if they hold an office of profit under govt.
❌ But the term is not clearly defined in law or Constitution.
⚖️ Exceptions Exist:
✅ Parliament can allow some posts by law.
✔️ Parliament (Prevention of Disqualification) Act, 1959 – Lists exempted posts.
✔️ Amended 5 times.
✔️ 2006 Amendment: 55 posts exempted – SC upheld it.
🧠 Key Point:
➡️ This rule ensures clean, unbiased governance by preventing misuse of power for personal gain.
