Zudem war er selbst kurz zuvor nur knapp einem islamistischen Anschlag auf ihn entkommen, bei dem er schwer verletzt überlebte.

Stürzenberger nahm immer Unterscheidungen vor, wie sie bei tatsächlicher Hetze nicht vorkommen:

„Wir haben nix dagegen, dass wir wirklich politisch Verfolgte aufnehmen, aber das sind die allerwenigsten. Viele kommen über Schlepper – und nicht wenige werden straffällig.“

Er spricht von „tausend Vergewaltigungsfällen von Moslems aus Nordafrika und Arabien“, verweist auf kulturelle Prägungen in islamischen Herkunftsländern und warnt vor einer Verharmlosung der Gefahren.

Seine scharfen, aber reflektierten und faktenbezogenen Äußerungen wurden ihm dennoch als Volksverhetzung ausgelegt.

Das Prinzip der Anknüpfungstatsachen verliert seine Bedeutung, wenn Gerichte sich weigern, diese überhaupt anzuerkennen.
