Why in News:
👉LG of Delhi permitted formation of medical board in all districts of the country
Key aspects
👉Surrogacy Regulation Act was came into force in 2022
👉It is permitted only for altruistic purposes or for couples who suffer proven infertility or disease.
👉Surrogacy is prohibited for commercial purposes
👉Once the child is born, it will be deemed to be the biological child of the couple for all intents and purposes
👉Under the Act, a couple should procure certificates of eligibility and essentiality in order to have a child via surrogacy
👉The couple can get an ‘essential’ certificate if suffering from proven infertility of either partner certified by a District Medical Board
Concerns
👉 The act is considered as too restrictive
👉It does not allow single women, or men, or gay couples to go in for surrogacy
Way out
👉Amendments might have to be resorted to in order to resolve the grievances and ensure access for all categories of parents.
