I have a poor memory. "I don't recall" or "I believe" ... can be helpful. But a judge can conclude, regardless, that U R not answering something that he/she believes you damn well know, such as the private keys to your crypto fortune and thus hold U in contempt or accuse U of obstruction.

The big hope is that he can reach an amicable settlement with the SEC. However, with the current chairman, GG, that won't be realistic.

I expect that he will have formally responded to the SEC complaint by August 21, three weeks after the complaint was filed or would have gotten an extension for more time.

Based on what I know, it is 21 days from the later of when the complaint was filed or when he was served. Since he is outside the u.s., that 21 days may go to 60 days. I suppose he could also request an extension beyond that.

I feel it's important he be meticulous regarding his 'answer' and get an extension if it will help him perfect it. I also heard from pundits that it makes sense for him to try to delay this process, so he can possibly point to future legislation and judicial precedent and maybe get a more sympathetic SEC chairman that would be willing to amicably settle with him before his case goes to a judicial ruling.

Yes they can. If there are u.s. investors that have bought HEX, PLS, or PULSX, the SEC has jurisdiction to bring the suit, even if RH were not a u.s. citizen.

RH could choose to respond with the middle finger, but then he would be subject to a default judgment against him. Unless I'm missing something, RH is a u.s. citizen anyway. This renunciation claim, absent solid info, is just hyperbole. He can't just renunciate citizenship to absolve himself of this.

RH is an American regardless where he physically is or his residence is. I'm sure RH has been legally served, even if he is not in the U.S. and I can't imagine RH is or would be trying to evade service anyway.

If the SEC doesn't offer a palatable deal to RH, it will come down to a judicial decision. This is what happened in the Ripple case. The SEC sees this as a trophy case, hence they will not likely be meaningfully open to making a palatable deal with RH.
