Explained | Difference between Article 226 and 227

1954.

1. Under Article 226, the High Court normally annuls or quashes an order or proceeding but in exercise of its jurisdiction under Article 227, the High Court, apart from annulling the proceeding, can also substitute the impugned order.

2. 226 is for infringment of right and can be claimed as right (ex debito justiciae) but 227 is vindication of HC authority for being state highest judicial authority and it can is discretionary & can be suo motu.

3. In 226 intra court appeal possible but in 227 it is not.

4. 227 can never be called a writ.

5. 227 cannot be exercised in alternative remedy eg. appeal. also 227 itself is not like appeal.

6. 227 Not ordinarily exercised.

7.  227 is to check jurisdiction is followed correctly by court tribunal.

8. 227 Natural justice violation, gross & manifest miscarriage of justice, patent perversity in orders.

9. Mere correction of error of law or fat not sufficient to invoke 227

10. if two views possible and court should have considered that view then also 227 cannot be invoked ( I doubt this will apply in case of benefit of doubt to accused because that is among 1st principles of criminal law and it is a gross miscarriage)

11. The power of 227 is wide and is used sparingly to maintain strict judicial and adminstrative control over state justice system.

12. In 226 individual cases are handled for remedy but in 227 is used to maintain public confidence in justice system.

13. The power under 227 is unfettered but is used very sparingly otherwise the object of 227 will be divested.

4. child of sex worker living in brothel should not be presumed to be a child who has been trafficked and separated from her mother, DNA test can be conducted if necessary to identify whether she is mother or not.
5. Media must not disclose identity of sex workers during arrest or raid and voyerism of offence must be used if necessary.
