For Judicial service, CLAT PG or UGC aspirant it is necessary to read recent judgments but of which court how and for what duration or interval, note making etc..

1. Read Monthly Digest of Supreme court
2. Only of those subjects which are in your syllabus
3. If it is reiteration of landmark judgment just read it for revision and nothing else untill very much highlighted in the news or repetited after long time (1959 landmark, reiterated in 2023 eg. Shah bano)
4. Make note of something new development in recent judgment.
5. For new development you must know provisions+ landmark judgemnts.
6. PYQ analysis is a must to understand the demand in prelims.

Comment if you use monthly digest or weekly round up or daily reading, which is more effective as per you?

⏱️ Concept of Dynamic+ Injunction

In Universal City v. Dotmovies. baby

Considering that there was a need to pass effective injunction orders as copyrighted films, TV series, etc. could be uploaded on rogue websites immediately upon release, a Dynamic+ injunction was granted, i.e. an injunction not only in respect of content/work existing at the time of filing of suit, but also future works of the plaintiffs in which their copyright exists and is violated by rogue websites.

People are mentioning Supreme court YT channel got hacked this shows they have nothing to share qualitatively because it is just a social media platform there is no different protection given to supreme court's channel or account it is same as normal YT channel if it can happen with big channels having millions of subscribers why not with SC? what's different?

If you want to talk about digital media hacking and cyber security issues then talk about government data hacked (by china based hackers) whose security is with government and not with any third party like YT.

Focus on Relevancy, ponder 🤔 how live streaming can get better and what's the future recourse, can we rely on YT?

🌟 What if there is hung house or a no-confidence motion?

Further, in the event of a hung house and a no-confidence motion, fresh elections may take place. Notably, the tenure will only be for the unexpired term in such cases. In other words, it will be the remainder of the full term, ie. for five years. Further, the expiration of this period shall operate as a dissolution of the House.

For example, if a government falls in a no-confidence motion in the second year of the house, then fresh elections can be held. However, the new government will only have the remainder term of three years. Amendments are proposed to Articles 83 and 172 in this regard.

Jurists' Views on Procedural Fairness

1. Lon Fuller’s "Inner Morality of Law": Fuller argued that for laws to be just, they must adhere to principles of transparency and consistency. He emphasized that if procedures are not clear and are applied arbitrarily, they lead to injustice.

2. H.L.A. Hart’s "The Concept of Law": Hart believed that procedural law (secondary rules) is crucial for the enforcement of rights. A legal system's effectiveness relies on clear and fair procedures, just as a prism must be clear to refract light correctly. When procedures are ambiguous, they lead to unjust outcomes.

3. John Rawls’ "Theory of Justice": Rawls championed the idea of "justice as fairness," where transparent and impartial processes are essential for justice. If procedures lack transparency, the justice system fails to deliver fair outcomes.

4. Roscoe Pound’s "Theory of Social Engineering": Pound viewed law as a tool for social progress, with procedure being the key to its effective application. Any distortion in the procedural framework leads to failures in achieving justice.

Case Laws

1. Maneka Gandhi v. Union of India (1978) – India
This landmark case emphasized that "procedure established by law" must be just, fair, and reasonable. The court held that procedures cannot be arbitrary and must ensure transparency to uphold justice.

2. Ridge v. Baldwin (1964) – United Kingdom
The UK House of Lords ruled that natural justice principles must be followed in procedural matters. The decision highlighted that even administrative actions must adhere to fair procedures, or else justice is compromised. In this case, Ridge, a police officer, was dismissed without being given a fair hearing.

3. Dharam Dutt v. Union of India (2004) – India
The Supreme Court reiterated the importance of procedural fairness in cases involving the deprivation of fundamental rights. The court held that any procedure that does not provide a fair chance to be heard bends toward injustice. This judgment reinforces the idea that a transparent procedural framework is essential for achieving justice.

4. Mapp v. Ohio (1961) – United States
In this U.S. Supreme Court case, the court ruled that evidence obtained through unconstitutional procedures (in this case, illegal searches) cannot be used in court. The procedure, if not transparent and fair, leads to a distortion of justice.
