PRIVATE MEMBERโS BILLS
PMBs are legislative proposals introduced by Members of Parliament (MPs) who are not Ministers (i.e., not part of the government), enabling them to raise issues and suggest laws or amendments on matters significant to their constituencies. It reflects individual viewpoints, not necessarily the governmentโs official agenda.
Procedure in Parliament
1. Introduced on Fridays in both Houses as per Rules of Procedure.
2. Follows the same stages as a government billโfirst reading, discussion, voting.
3. Can become law if passed in both Houses and gets Presidential assent.
Recent Data and Decline: (Source: PRS Legislative Research)
โญ๏ธ Only 14 PMBs passed since Independence; none since 1970 passed both Houses.
โญ๏ธ17th Lok Sabha: 729 PMBs introduced (only 2 discussed).
โญ๏ธ 18th Lok Sabha (2024): 64 PMBs introduced, zero discussed so far.
โญ๏ธIn 2024 Winter Session, Lok Sabha spent just 0.15 hours on PMBs and Rajya Sabha 0.62 hours.
Significance of Private Memberโs Bills
1. Encourages Democratic Expression: Enables MPs to propose legislation on personal conviction or constituency needs.
E.g. Supriya Suleโs โRight to Disconnectโ Bill (2019).

Reforms Needed
1. Protect Friday Time for PMBs: Amend rules to make this time non-negotiable, barring national emergencies.
2. Midweek Scheduling: Shift PMB discussions to Wednesdays to avoid low attendance.
3. Priority Committee for PMBs: Set up an expert review panel to shortlist high-impact Bills for fast-track discussion.

4. Extend Working Hours: Parliament may sit longer to accommodate both government and private business.

Conclusion:
Private Memberโs Bills are a vital democratic instrument for MPs to reflect public aspirations and challenge dominant narratives. Their erosion reflects a centralised legislative process, undermining deliberative democracy. Reviving and reforming the PMB mechanism is essential to restore participatory law-making in Parliament.

Union of India (2019) 3 SCC 39) - This Court was neither called upon nor has it ventured to pronounce on the effect of Sections 45 and 63 of the 1950 Act as also the corresponding provisions in other Acts or any other provisions of the Acts. We only make this position clear. Adultery - Joseph Shine v. Union of India (2019) 3 SCC 39 - It is not as if this Court approved of adultery. This Court has found that adultery may be a moral wrong (per Honโble Ms. Justice Indu Malhotra). This Court has also held that it will continue to be a ground for securing dissolution of marriage. Well AI can be used in SC and HC for better translation we can become 1st multilingual courts and that is possible but the current system lacks accuracy but yes the argument of finance can be countered because we are talking about access to justice in 1 Supreme Court and 21 High Courts.
English + Regional Language and English + 22 Official Languges in Supreme Court must be the criteria.

This issue must not be seen as a development goal but as a continous violation of Fundamental Right that is Access to justice which is in itself very broad and intention of constitution makers on making it temporary and adopt native language.
The Adminstrative problems were precedents in english, hindi and other langauges legally were not developed and judges were not trained, today we have solution for all this.
The debate of hindi v. regional can also be solved by adopting multilingual possible approach.
Technology can be used to achieve the preambular objectives and it must be the duty of state to use it for its citizens. (FR- No discrimination on language/DPSP- welfare state)
Accross the Globe many british colonies have clearly adopted native languages for courts, India's colonial mindset needs to be changed that too when there are solutions.
