የሕዝብ ተወካዮች ም/ቤት የኢትዮጵያ ሕንፃዎች አዋጅን፤ አዋጅ ቁጥር 1356/2017 አድርጎ በሙሉ ድምጽ ማጽደቁ ይታወሳል።

አዋጁ የወጣው በነባሩ የኢትዮዽያ ህንፃ ሕግ ይታዩ የነበሩ ክፍተቶችን በመሙላት የህዝብ መገልገያ ህንፃዎች ለአካል ጉዳተኞች ተደራሽነትንና ተጠቃሚነትን ለማረጋገጥ ለማስቻል ነው ተብሏል።

አዋጁ ከመጽደቁ በፊት ረቂቁ ለከተማ መሰረተ ልማት እና ትራንስፖርት ጉዳዮች ቋሚ ኮሚቴ በቀረበበት ወቅት ረቂቁ ከዚህ ቀደም የነበረውን "ባለሞያ ተኮር " ሂደት በአዲሱ ረቂቅ "ድርጅት" ተኮር እንዲሆን መደረጉ አግባብ አይደለም በሚል ከኢትዮጵያ አርክቴክቶች ማህበር እና ከሌሎችም ትችት ሲቀርብበት ነበር።

ከዚህ ቀደም በነበረው አዋጅ ባለሞያ ተኮር የሆኑ እና የባለሞያውንም የሞያ ክብር የሚያረጋግጡ አንቀጾች በአዲሱ ረቂቅም እንዲካተቱ እና ወደ ድርጅት ተኮር ወደ ሆነ አሰራር እንዳይቀየሩ የኢትዮጵያ አርክቴክቶች ማህበር ጠንከር ያለ ክርክር ሲያደርግ ቆይቷል።

ክርክር ሲያደርግ ከቆየባቸው ነጥቦች ውስጥ አዋጁ ማተኮር ያለበት እያንዳንዱ ባለሞያ ማለትም አርክቴክት፣ ስትራክቸራል ኢንጂነር፣ የኤሌክትሪክ ባለሞያ የሚመለከተውን ስራ ብቻ እንዲሰራ አዋጁ ማረጋገጥ አለበት የሚለው አንዱ ነው።

ይህ ካልሆነ ድርጅቱ እነዚህን ባለሞያዎች ቀጥሮ ሲያሰራ ሃላፊነታቸውን በትክክል መወጣታቸውን በማያረጋግጥ መንገድ ከመሆኑም በላይ ጥቅሙ ወደ ድርጅት ሲሄድ ጥፋት ሲኖር ግን የጥፋት ተጠያቂነትን ወደ ባለሞያው የሚያመጣ አሰራር መሆኑን ሲገልጽ ቆይቷል።

በተጨማሪም የህንጻ ዲዛይን ስራን ማንኛውም ሰርተፍኬት ያለው ባለሞያ ወይም ሌላ ሰው ማስተባበር እንዲችል በመጀመሪያው ረቂቅ ላይ መቅረቡ አግባብ አለመሆኑን እና ሁሉም ሙያውን አክብሮ እንዲሰራ መደረግ እንዳለበትም ሲገልጽ ቆይቷል።

የማህበር ፕሬዝዳንት አርክቴክት ሐብታሙ ጌታቸው ለቲክቫህ ኢትዮጵያ እንደተናገሩት "ረቂቁ ላይ ሃሳባችንን ከሰጠን በኋላ የመጨረሻ ረቂቁን የማየት እድል አልነበረንም አሳዩን ስንል እናንተ የምትሰጡትን ግብአት ስለጨረሳችሁ ተሳትፏቹ አልቋል ስንባል ከተጠያቂነት ለመዳን በሚል ረቂቁ በሙያ እና በሙያ ባለሙያ ላይ ስጋት የሚያሳድር በመሆኑ ስጋቶች አሉን በሚል አቋማችንን አሳውቀናል" ብለዋል።

ማህበሩ በወቅቱ በአቋም መግለጫው ያሳወቃቸው እና በረቂቁ ላይ መካተት አለባቸው በማለት አጽንኦት የሰጠባቸው ነጥቦች

1) አዋጁ ድርጅት ተኮር ሳይሆን ባለሙያ ተኮር ተደርጎ መዘጋጀት እንዳለበት።

2 ) የሙያ ጥሰት ተጠያቂነት የሚመጣው በገለልተኛ የባለሙያ ቦርድ ተገምግሞ እንጂ ሚዛናዊነትን ባልጠበቀ መልኩ አንድ ተቋም ራሱ ከሳሽ ራሱ መርማሪ እና ራሱ ፈራጅ መሆን እንደሌለበት።

3 ) የሕንፃ ዲዛይን ስራ የአርክቴክቱ የፈጠራ ውጤት እንደመሆኑ በብቸኝነት የዲዛይን ስራን ማስተባበር ያለበት አርክቴክቱ መሆን አለበት የሚሉ ነበሩ።

የማህበሩ ፕሬዝዳንት አርክቴክት ሐብታሙ በአቋም መግለጫው የተካተቱት ነጥቦች በትክክል መመለሳቸውን እና በአዋጁ ተካተው እንዲጸድቁ መደረጉን ነግረውናል።

"በተለይ የባለሙያውን ሚና ላይ አሉታዊ ተፅዕኖ ሊያሳድሩ የሚችሉ እና እንደ ስጋት የጠቀስናቸውን መሰረታዊ ጉዳዮች በሙሉ ምላሽ በማግኘታቸው ይህንን ድምፃችንን ሰምተው ተገቢውን ማስተካከያ ያደረጉ አካላትን በሙሉ ማህበሩ ማመስገን ይፈልጋል" ብለዋል።

"በብዛት እኛ ሃገር ያለው ልምምድ እንደሚያሳየው የህንጻውን ዲዛይን የሰራው ባለሞያ ሳይሆን ሌሎች ገብተው ህንጻውን ሲያምሱት ይታያል መጨረሻ ላይ ተጠያቂ የሚሆነው ግን ዲዛይነሩ ነው የአሁኑ አዋጅ ግን በግልጽ ህንጻውን ዲዛይን ያደረጉት ሰዎች ገብተው ሥራውን ሰርተው ተቆጣጥረው የማስረከብ ሃላፊነትን ከተጠያቂነት ጋር ሰጥቷል ለዚህም ምስጋና አለን" ብለዋል።

የማህበሩ ፕሬዝዳንት "ገለልተኛ የሞያ አጣሪ ቦርድ የሚለው ወይም በአቋም መግለጫው ላይ በሁለተኛነት የተቀመጠው ይቀራል በደንብ እና በመመሪያ ጸንቶ ይወጣል ብለን እናስባለን ተጠሪነቱ ለተቋሙ መሆን የለበትም ነው የምንለው የፍትህ መዛባት እንዳያስከትል ይህን መለየት አለብን የሚል አቋም አለን "ሲሉ አክለዋል።

🏷Definitions of terms

1. Course : A course is a horizontal layer of bricks stones 

2. Bed : the surface of a stone perpendicular to the line of pressure of (lower surface of bricks or stones in each course)

3. Back : The inner surface of wall not exposed is called back. 
The material forming back is known as backing 

4. Face : The exterior of the wall exposed to weather is known 
as face. The material used in the facing of wall is known as 
facing

5. Hearting : It is the interior portion of a wall between facing 
and backing 

6. Head : It is a brick or stone, which lies with its greatest length  at right angles to the face of the work. 

7. Stretcher : It is a brick or a stone which lies with its congest 
side parallel to the face of the work 

8. Bond : The method of arranging bricks so that the individual  units are tied together
 
9. Spalls : The chips of stones used for filling the interstices in 
stone masonry
 
10. Quoins : The stones used for the corners of walls of structure 

11. Bat : It is a portion of a brick cut across the width. 

12. Closer: It is the portion of a brickcut in such a manner that its  one long face remains uncut 

13. Queen closer: it is the portion of a brick obtained by cutting a  brick length-wise into two portions

14. King closer: It is the portion of brick obtained by cutting off 
the triangular piece between the centre of one end and the 
centre of one side. 

15. Bevelled closer: It is the portion of a brick in which the 
whole length of the brick is bevelled for maintaining half 
width at one end and full width at the other 

16. Frog : It is an indentation or depression on the top face of a 
brick made with the object of forming a key for the mortar. 

17. Sill : It is a horizontal stone, concrete or wood, employed for 
the purpose of shedding off rain water from the face of wall 
immediately below the window opening 

18. Corbel : It is the extension of one or more course of stone or 
brick from the face of a wall to serve as a support for wall 
plates

19. Templates : Pieces of stones placed under the end of a beam 
to distribute load over a greater area. 

20. Coping : It is the course placed upon the exposed top of an  external wall to prevent the seepage of water 

21. Buttress : It is a sloping or stepped masonry projection from a  tall wall intended to strengthen the wall against the thrust of a roof.

👉የህንጻ ግንባታ የአካል ጉዳት ያለባቸውን ሰዎች ተገልጋይነት ታሳቢ ማድረግ ይኖርበታል‼️

🚧በኢትዮጵያ የህንጻ አዋጅ አንቀጽ 36 ላይ "ማንኛውም የህዝብ መገልገያ ህንጻ ውስጥ በተሸከርካሪ ወንበር ለመንቀሳቀስ የሚገደዱትን እና መራመድ የሚችሉ ሆኖ ደረጃ መውጣት የሚሳናቸውን ጨምሮ የአካል ጉዳት ላለባቸው ሰዎች የሚመች መዳረሻ መዘጋጀት አለበት" በሚል በግልጽ ተደንግጓል፡፡

▶️ድንጋጌው በአስገዳጅ/obligatory/ ሁኔታ የተቀመጠ ነው፡፡

▶️በተጨማሪም በህንጻ ግንባታ ወቅት የሚሰሩ መጸዳጃ ቤቶች የአካል ጉዳት ላለባቸው ሰዎች የሚመቹ እና ሊደርሱባቸው የሚችሉ መሆን ይኖርባቸዋል፡፡

💫እነዚሁ መጸዳጃ ቤቶችም በበቂ መጠን/ቁጥር መኖር ይገባቸዋል፡፡

▶️ሌላው ከመሬት ወለል በላይ/above the ground floor/ ከ20(ሀያ) ሜትር
በላይ ከፍታ የሚኖራቸው የህንጻ ግንባታዎች ልዩ ግዴታ አለባቸው፡፡

▶️ይሄውም ህንጻው አሳንሰር ወይንም ተመሳሳይ አገልግሎት ሊኖረው እንደሚገባ እና አሳንሰሩም ያለማቋረጥ አገልግሎት መስጠት እንደሚገባው የህንጻ አዋጁ አንቀጽ 33(4) እና(5) ይደነግጋል፡፡

▶️ስለዚህ አሳንሰር ከግራውንድ ፍሎር ጀምሮ ወደላይ ከሀያ ሜትር በላይ ከፍታ ላላቸው ህንጻዎች የቅንጦት ሳይሆን በህግ የተቀመጠ ግዴታ ነው ማለት ነው፡፡

▶️ይህን የህንጻ ግንባታ ህግ መጣስ ደግሞ ከህንጻ አዋጁ አንቀጽ 47 ጀምሮ በተደነገገው አግባብ የወንጀል ተጠያቂነትን ያስከትላል፡፡

▶️ስለሆነም የህንጻ አዋጁ በሚያስቀምጠው አግባብ የህንጻ ግንባታዎችን እንዲከናወኑ ማድረግ ከተጠያቂነት የሚያድን ከመሆኑም ባሻገር የአካል ጉዳት ያለባቸው ሰዎች በህግ የተሰጣቸውን መብት እንዲገለገሉ ምቹ ሁኔታ መፍጠርም መሆኑን ለመጠቆም እንወዳለሁ፡፡

👉አሳሳቢ የሆነው የኪነህንጻ ንድፍ ሙያ (Opinion Piece)

🚧በአሁኑ ግዜ በኢትዮጵያ ውስጥ በኪነህንጻ ንድፍ ልህቀት ያስመዘገቡ እና በዋና ሙያነት ህንጻ የሚነድፉ ወጣት  ጥበበኛ  ባለሙያዎችን እያጣን የምንገኝ ይመስላል።

በምትኩ ወጣት ህንጻ ነዳፊዎች ውስጣዊ ግንባታን ጨምሮ ግራፊክስ እና ሌሎች ተዛማጅ ስራዎችን በመምረጥ ከንድፍ ሙያ እየራቁ መሆኑን  መገመት አያስቸግርም።

ከንድፍ-ግንባታ (Design Build) ስራ የተነሳም ስኬታማ የሚመስሉ ነዳፊዎች በገንቢዎች ስር ሆነው ለመስራት እየተገደዱ መሆናቸውን እንመለከታለን።

ዘመናዊው ኪነህንጻ በአገራችን ወርቃማ በነበረበት በ1950ዎቹ እና 60ዎቹ ዘመን የነበሩት ነዳፊዎች እንደአለምአቀፉ ልምድ ሁሉ ከግንባታ ዋጋ 4 በመቶ እና ከዝያ በላይ ለንድፍ ያስከፍሉ እንደነበር መዛግብት ያሳያሉ።

በሶሻሊስታዊው ዘመን ብዙ ህንጻ ባይገነባም ለንድፍ ሙያ  የነበረው ክፍያ ከዚህ እምብዛም የራቀ አልነበረም።

ከ1983ቱ ለውጥ በኋላ ግን ሙያው እንደማንኛውም ሸቀጥ በአነስተኛ ዋጋ አቅርቦት እንዲመራ በመደረጉ   የንድፍ ስራ ክቡርነት ስለጠፋ በህንጻዎች ላይ  የስፍራ፣ የአገልግሎት ፣ የመዋቅር እና የግንባታ ከፍተኛ ጥራት መጉደል ሊከሰት ችሏል።

ከዚህ ከንድፍ ሙያ ክፍያ ጋር ተያይዞም በአሁኑ ሰአት በልህቀት ኪነህንጻን የሚሰሩ ወጣት ባለሙያዎችን ማግኘት ከባድ እየሆነ የመጣ ይመስላል።

በአገራችን ወጣት ነዳፊዎች በሙያው ላይ የሌሉ ይመስል ድንቅ ስራዎቻቸውን ሲያቀርቡ አናይም።

ሌሎች ተዛማጅ አትራፊ  ሙያዎች እንደሳቧቸው  ለመገመት የሚያስቸግር አይደለም።

አገራችንን ስም ሲያስጠሩ የምናያቸው ባለሙያዎቻችን እድሜአቸው በአርባዎቹ መጨረሻ አብዛኞቹ ደግሞ በሀምሳዎቹ እድሜ ክልል መሆናቸው ሙያው ጠንካራ ተተኪ ያላገኘ አስመስሎታል።

ሙያው ጥብቅና በሚደረጉ ስብሰባዎችም ላይ እነዚሁ አንጋፋ ነዳፊዎችን ብቻ ዘወትር በብዛት መመልከትም እንግዳ ነገር አይደለም አንጋፋዎቹ የንድፍ እልፍኞች ባለሙያ የሚርመሰመስባቸው የጥበብ ቦታዎች ሳይሆኑ በብዛት ዋነኞቹ ባለሙያዎች የእለት ተእለት ስራ የሚከውኑባቸው ስፍራዎች ናቸው።

በሰሞኑ በነበሩት በህንጻ እና በተዛማጅ ህጎች ላይ የህንጻ ነዳፊዎች ለሙያቸው እና ለባለሙያዎች ክብር ያደረጉት ጥብቅና እጅግ የሚመሰገን ሆኖ ባለሙያዎች ሙያው ተገቢው ክፍያ እስኪያገኝ ድረስ ረጅም ውትወታ ማድረግ እንደሚኖርባቸው ይጠበቃል።

አለበለዝያ ሙያው ከጥበብ በራቀ መንገድ እየሄደና በ (design build) ገንቢ ድርጅቶች እየተመራ ታዋቂ ነዳፊዎችን የሚተካ አዲስ ትውልድ እያጣን እንመጣለን።

ንድፍ ብቻውን ያለግንባታ ስራ ተገቢው ክብር እና ክፍያ እስኪኖረው አበክረን መስራት አለብን።

👉የጸደቀው የሕንፃ አዋጅ የስነ ሕንጻ -ንድፍ ሙያተኞች ላይ ስጋት እንደሚፈጥር ተገለጸ

አዲሱ የሕንፃ አዋጅ የስነ ሕንጻ -ንድፍ ባለሙያ (አርክቴክቶች)ን ሙያ የሚያሳጡ ነጥቦች የተካተቱበት ነው ሲል የኢትዮጵያ አርክቴክቶች ማህበር ቅሬታውን ለአሐዱ ገልጿል።

በዛሬው ዕለት በተከናወነው 6ኛው የሕዝብ ተወካዮች ም/ቤት በ4ኛ ዓመት የሥራ ዘመኑ 9ኛ መደበኛ ስብሰባ ላይ የሪል ስቴት ልማትና የማይንቀሳቀስ ንብረት ግብይትና ግመታ አዋጅን ጨምሮ ሦስት አዋጆችን መርምሮ አጽድቋል።

"ይሁንና በፀደቀው አዋጅ ላይ ቅሬታችንን ብናቀርብም ተቀባይነት ተነፍጎንናል" ያለው የስነ ሕንፃ ንድፍ ባለሙያዎች ማሕበሩ፤ ቀድሞውኑ በረቂቅ አዋጁ ላይ ቅሬታው እንደነበረው አስታውቋል።

የስነ ሕንጻ - ንድፍ ባለሙያዎች ማህበር፤ "በቀድሞው የሕንፃ አዋጅ ላይ ተጠብቀው የኖሩና የሕንፃ ንድፈ ሐሳብ አፍላቂዎችን የሕንፃ ሥራ ባለሙያዎችን የማያካትቱ አሰራሮችን በአዲሱ አዋጅ ላይ ተካተዋል" ሲል ገልጿል ፡፡

በሕንጻ ሥራ ላይ ተጠያቂነት የሚሰፍንበትን አካሄድ ያላከበረ ከመሆኑ በተጨማሪም፤ በአለም ዓቀፍ ካለው ልምድ አንፃር የሚጣረስ መሆኑም ገልጿል፡፡

በሂደት ላይ በነበረው የሕንጻ ሥራ አዋጅ ላይ የተሰተዋሉትን ቅሬታዎች ለምክር ቤቱ ቢያቀርቡም ተቀባይነት አለማግኘታቸውን ለአሐዱ የገለጹት የማህበሩ ፕሬዝዳንት ሐብታሙ ጌታቸው ናቸው።

ሌላኛው በአዋጁ ላይ ከተነሱት ቅሬታዎች መካከል ሕንጻ በሚገነባበት ወቅት በሌሎች ባለሙያዎች በሚፈጥሩት ስህተት የስነ ሕንጻ ንድፋ ወይንም የአርክቴክቸር ባለሙያዎችን ተጠያቂ የሚያደርግበትን አካሄድ አንዱ እንደሆነም ማሕበሩ ስሞታውን ለአሐዱ አሰምቷል።

የማሕበሩ ፕሬዝዳንት አክለውም፤ የሙያ ደህንነትን ጉዳይ አሳሳቢ ደረጃ ላይ መውደቁን የገለጹ ሲሆን፤ "በተጨማሪም አዋጁ በግንባታ ዘርፍ ላይ ለሚደርሱ ጥፋቶች ተጠያቂነትን የማያሰፍን ነው" ሲሉ ተችተዋል።

አዋጁ ባለፈው ወር ለሕዝብ እንደራሴዎች ምክር ቤት ለውይይት ቀርቦ የነበረ ቢሆንም፤ በርካታ አለመግባባቶች የተስተዋሉበት እንደነበር አሐዱ መዘገቡ ይታወሳል።

የኢትዮጵያ ግንባታ ተቋራጮች ማሕበርን ጨምሮ የኢትዮጵያ አርክቴክቶች ማህበር በአዋጁ ላይ ከፍተኛ ትችት ከሰነዘሩ መካከል ይገኙበታል

ነገር ግን እነዚህ ቅሬታዎች እና ትችቶች ምላሽ ሳያገኙ ምክር ቤቱ አዋጁ ተፈፃሚ እንዲሆን አፅድቆ ወደ የሚመለከተው አካል መምራቱ ነው የተገለጸው።

👉የታላቁ ሕዳሴ ግድብ ግንባታ 97 ነጥብ 6 በመቶ መጠናቀቁ የፕሮጀክቱ ማስተባበሪያ ጽሕፈት ቤት አስታውቋል

የኮርቻ ግድቡ በ2010 ዓ.ም ሙሉ በሙሉ ተጠናቆ በአራት ተከታታይ ዙር ዓመታዊ ውኃ መያዝ መጀመሩና ሁለቱን ግድቦች የሚያገናኘው የድልድይ ሥራ ሙሉ በሙሉ እየተጠናቀቀ እንደሚገኝም ተናግሯል፡፡

በተጨማሪም የግድቡ የማስተንፈሻ በሮች ሙሉ በሙሉ መጠናቀቃቸው የተገለጸ ሲሆን፤ የኤሌክትሮ ሜካኒካል ሥራዎች 87 በመቶ መድረሱን አመላክቷል፡፡

1 ሺሕ 800 ሜትር የሚረዝመው እና ከባህር ጠለል በላይ 645 ሜትር ከፍታ ያለው የዋናው ግድብ የሲቪል ሥራዎች አፈፃፀም 99 ነጥብ 6 በመቶ በላይ የተጠናቀቀ መሆኑንም ጽ/ቤቱ ለአሐዱ በላከው መግለጫ አስታውቋል፡፡

ከዚህ በተጨማሪም በበጀት ዓመቱ አራት ወራት ለግድቡ ግንባታ ከ311 ሚሊዮን ብር በላይ መሰብሰቡን ገልጿል፡፡

እንዲሁም ከ2005 ዓ.ም ጀምሮ እስከ ጥቅምት 30 ቀን 2017 ዓ.ም ድረስ ባሉ 12 ዓመታት፤ ለግድቡ ግንባታ ከ20 ነጥብ 2 ቢሊዮን ብር በላይ መሰብሰቡን ጽ/ቤቱ ገልጿል።

እስካሁን ኃይል እያመነጩ ካሉት የግድቡ አራት ተርባይኖች ሁለቱ ተርባይኖች እያንዳንዳቸው በሙሉ አቅማቸው 375 ሜጋ ዋት ኃይል የማመንጨት አቅም እንዳላቸው የተገለጸም ሲሆን፤ ቀሪዎቹ ሁለቱ ደግሞ 400 ሜጋ ዋት ኃይል የማመንጨት አቅም አላቸው፡፡

የቀሪዎቹ 9 ዩኒቶች ተከላና የቅድመ ኃይል ማመንጨት ሙከራ ተጠናቆ በሙሉ አቅማቸው ኃይል ማምረት ሲጀምሩ ደግሞ፤ አሁን ያለውን የአገራችንን የኤሌክትሪክ ኃይል የማመንጨት አቅም በ83% እንደሚያሳድገው ተነግሯል፡፡

ታላቁ የህዳሴ ግድብ ፕሮጀክት ሲጠናቀቅ ደግሞ 5 ሺሕ 150 ሜጋ ዋት የኤሌክትሪክ ኃይል የሚያመነጭ ሲሆን፤ ዓመታዊ የኃይል ምርቱ ደግሞ 15 ሺሕ 760 ጊጋ ዋት በሰዓት እንደሚሆን ይጠበቃል!

ተቋሙ ባወጣው ባለ 79 ገጽ አዲስ ሪፖርት በሳዑዲ አዳዲስ ትላልቅ ፕሮጄክቶች ሲገነቡ ''መጀመሪያ ሙት፤ ቀጣይ ይከፈልሃል'' የሚል ጭቆና የተሞላበት አሰራር እንዳለ አመላክቷል፡፡
