Dear colleagues, I searched information about the registration fees for IP on European Union customs and found out that IP protection is provided through the IPEP Trader Portal that is totally free of charge. All right-holders must have an EORI number (Economic Operators Registration and Identification number) and its free to get in authority too. I am very surprised. Has anyone encountered this issue? I would be very grateful for your help.

During his service in Serbia during World War I, the German Albin Grau was impressed by the local farmers’ stories about vampires to the point that he decided to make a movie about them.

Bram Stoker’s Dracula became a prototype for the film. The director saw it as an impressionist retelling of the famous vampire’s story, however, the author’s widow, who held the rights for Dracula at the time, refused to give her consent for the use of the work.

In these circumstances, Grau decided to play a trick: he purposefully altered some of the narrative lines, facts, and names used in the work. For instance, in the film, sunlight does not weaken but kills vampires, victims bitten by vampires die, and the protagonist is not so much of a human, rather an anthropomorphic monster with huge claws. All this was meant to dodge copyright claims, and as the result, in 1922, the film Nosferatu. A Symphony of Horror was released.

Unsurprisingly, Bram Stoker’s widow filed a lawsuit against Albin Grau; he lost the case and as a consequence went bankrupt. Moreover, the court ordered to burn all reels of the film, which was executed, so that not a single copy of the film remained in Europe.

However, by then, one copy of the film had already made it to the US, where Dracula was in the public domain due to a legal error. From the position of contemporary law, this error was a funny one: the original of the book that arrived to the US did not bear any mention of copyright, which automatically placed the work in the public domain. This issue will be solved much later, when in 1988 the USA will sign the Berne Convention on the protection of literary and artistic works.

According to the legislation in place at the time, it was not possible to demand that the US authorities destroy the film reel. Having made a tremendous success in US movie theatres, after over 50 years following the death of the original Dracula’s author, the film returned to Europe and is now considered a classic of horror movies, which not only profoundly influenced vampire films, but also contributed to the shaping of the very idea of these monsters. In one of the scenes of his 1992 film, Francis Ford Coppola actually had to explain to the viewers why the protagonist did not die from sunlight.
