New case for our readers! Let us imagine that the owner of a second-hand store that sells items imported from the EU uses the Armani logo in a post on the social media account of the shop in order to attract more clients. Can the shop owner legally do this?

Indeed, what becomes of Armani outfits turned into a second-hand store and first resold at the territory of the EU? Legally speaking, in certain cases the aura of luxury rule may apply.

According to this legal concept, brand fashion goods (under the Armani brand, in our case) are not reduced to the clothes or footwear they literally are, but correspond to a particular consumer lifestyle, which includes, among other things, specific advertising and sales conditions. These latter stipulate the sale through a fashion outlet in a trendy downtown area.

In fact, the aura of luxury concept assumes that the owner of the fashion brand does not plan for the goods to be sold second-hand at all, because this would damage its “fashion attractivity”.

As a consequence, sales through such distribution channels will be automatically qualified as trademark infringement, even if the original Armani product was initially purchased at a luxury store and only resold as second-hand.

Thus, if the reseller of Armani outfits sells brand goods as “non-luxury” second-hand items in the EU territory, then this sale may be pronounced unlawful and recognized as infringement of the Armani trademark. Even the export of such second-hand goods to countries outside the EU will not help legalize the posterior sales.

However, the aura of luxury rule does not apply to Armani clothes bought at a brand store outside the EU, for instance, in Serbia, and then resold as second-hand product, as presently the aura of luxury concept does not operate in Serbia (and some other countries).
