We are writing to inform you of significant changes announced by the United States Patent and Trademark Office (USPTO) regarding TRADEMARK FEES. Effective January 18, 2025, the USPTO will implement a revised fee structure that may impact various aspects of the trademark process, including application filings, intent-to-use filings, and post-registration maintenance. APPLIES TO CURRENTLY PENDING AND REGISTERED TRADEMARKS.
Key Changes to Trademark Fees:
Application Filing Fees:
Base Application Fee: The previous TEAS Plus and TEAS Standard application options are being replaced with a single base application fee of $350 per class. (Most of our clients were already paying the base fee of $350 so most of you won’t be affected).
Surcharges (NEW APPLICATIONS):
(EXISTING) Insufficient Information: A surcharge of $100 per class will apply if the application lacks required information.
(NEW) Custom Goods/Services Descriptions: If you provide a list of goods/services that is not on the approved identification of goods and services and we have to use a free-form text box to enter goods or services descriptions in your application, this will incur a $200 surcharge per class.
(NEW) Goods/Services descriptions Exceeding Character Limit: For recitations of goods and services exceeding 1,000 characters per class, the USPTO will impose an additional fee of $200 for each subsequent block of 1,000 characters, per class. However, applicants who utilize identifications from the USPTO ID Manual will not be subject to this fee, regardless of character count. Similarly, applications filed under the Madrid Protocol will be exempt from this surcharge.
Short Identifications: If an identification is concise, such as "clothing" (8 characters), a 1,000-character limit could accommodate over 100 separate items (e.g., "clothing; footwear; headwear").
Medium-Length Identifications: Identifications such as "downloadable software for managing databases" (42 characters) allow about 20-25 entries within 1,000 characters.
Complex Identifications: Detailed descriptions, such as "entertainment services in the nature of live musical performances" (65 characters), could fit approximately 15 entries within the limit.
Intent-to-Use Filings:
Amendment to Allege Use (AAU): Fee increased from $100 to $150 per class.
Statement of Use (SOU): Fee increased from $100 to $150 per class.
Post-Registration Maintenance:
Section 8 (Declaration of Continuos Use) & 71 (madrid protocol applicants only) Declarations: Fee increased from $225 to $325 per class.
Section 9 Renewal: Fee increased from $300 to $325 per class.
Section 15 Declaration: Fee increased from $200 to $250 per class.
Petitions and Other Filings:
Petition to the Director: Fee increased from $250 to $400.
Petition to Revive an Application: Fee increased from $150 to $250.
Letter of Protest: Fee increased from $50 to $150.
