Wouldn’t it be better to do the EPO instead of DE, FI, FR, UK, ES and IT separately? For that you’d generally need 6 attorneys and 5 translations (assuming PCT is in English).

​👀 A few facts about Libya and Lebanon

Today we would like to share some interesting facts about obtaining a trademark registration in different jurisdictions.

"Insiders only" system in Libya

We are used to having at our disposal several different ways to register a brand: national, regional, and international systems. But the Libyan Trademark Office provides much few opportunities for international businesses. While there are regional IP organizations in Africa, like OAPI and ARIPO, Libya is not a member of any of them.  

It is not only that international or regional registration systems are unavailable in Libya, but also filing trademark applications in this country is exclusively open to companies that own national production and service units. 

This limitation was introduced in November 2022 as a temporary measure, but it has not been abolished yet. As the result, since the end of last year, foreign entities cannot obtain a trademark registration in Libya.

At least, this system works consistently…

Another country where trademarks can only be registered under the national system is Lebanon. But the IP Office there systematically suspends its operations due to strikes directed by the Ministry of Commerce. During such periods, the Trademark Office postpones the deadlines for renewal and extends the limits for registration process. 

At least, this system works…

Because in some African countries, having a functioning trademark office is already a success. For example, in Somalia, the IP Office remained closed for many years and has only recently resumed its operations. During the suspension period, the only way to protect intellectual property rights was by publishing a “cautionary notice” in a local newspaper. 

To sum up, if you are planning to register a trademark in an African or Arab country, you should always keep in mind that the legislation there constantly changes.
