​⛔️ The rapid development of AI raises concerns

On March 30, 2023, the Center for AI and Digital Policy (hereinafter, the “CAIDP”), which seeks to ensure that modern technology does not violate the rights and democratic institutions, filed a complaint with the US Federal Trade Commission (hereinafter, the “FTS”) demanding to halt further commercial deployment of Chat GPT-4 by OpenAI.

Chat GPT-4 was released on March 14, 2023, and impressed everyone with the quality and plausibility of its responses. However, the fact that OpenAI did not disclose anything about the creation of Chat GPT-4, its training, and data collection caused heated discussion worldwide.

What grounds did the CAIDP use for filing the complaint?

▫️Misleading consumers

While in most cases Chat GPT-4 gives correct answers to users' questions, it may also provide incorrect information.

The CAIDP expressed concern that consumers may, for instance, receive negative advice on investments or managing debt, preventing access to credit or increasing the price of health insurance. If consumers are misled like this in these and other areas of public life, the consequences can be detrimental.

▫️Protection of children

Children can receive dangerous advice from Chat GPT-4. For instance, there have been cases when AI instructed a child on how to cover up a bruise ahead of a visit from Child Protective Services or offered advise on how to lie to parents about a trip that the child took with a 31-year-old man.

▫️Cybersecurity

Online fraud can be more effective with Chat GPT-4. AI is capable of confusing consumers and passing off fraudulent offers as legitimate.

Besides, Chat GPT-4 can be used to generate polemics in the style of mass shooters, fake forum threads discussing Nazism, and so on.

▫️Privacy

Privacy risks associated with generative AI are extremely high. As the data controller, OpenAI must comply with the general principles of data processing: data minimization, confidentiality, accountability, etc. Apparently, OpenAI has no legal authority to process personal data of individuals.

Another issue was raised when OpenAI made private chat histories visible to other users. This creates significant risks. Imagine a fraudster who could one day break into someone's account, view chats, and access billing information.

Based on the above and other arguments, the CAIDP asked the FTS to begin an investigation of Chat GPT-4 products and initiate a rulemaking to establish baseline standards for products in the Generative AI market sector.

Recently, the FTS has launched an investigation of Chat GPT-4 and sent a civil investigation demand to OpenAI. OpenAI will have to indicate what measures have been taken to eliminate all the risks described above by providing the information about the company, disclosures and representations, model development and training, and so on.
