🇻🇦 A letter to CLAIMS from the Vatican: Papal copyright
Do you remember AI-generated pictures of the Roman Pontiff, wearing a puffy jacket? Well, realistic as these photos are, they are deepfakes.
If lawyers mostly argue whether deepfakes should be considered as a personal rights infringement, in the Vatican there is an IP question, too.
As it is stated in the Law on the protection of copyright and related rights in Vatican, the image and voice of the Roman Pontiff are considered copyright objects. We were curious to know whether deepfakes of the Pope are infringing his IP rights. While looking for an answer, we wrote a letter directly to the Dicastery for Communication, a special Vatican office which gives authorization for any use of the Pontiff’s image.
Here’s an interpretation of this Papal copyright from the representatives of the Dicastery:
▫️ The Dicastery confirmed that the copyright covers both the appearance and the voice of the Pontiff.
▫️ The employees of the Dicastery are still undecided as to who is the copyright holder: either the Pope, or the Holy See.
▫️ This copyright is protected extraterritorially at the international level, which means that unauthorised use of the Pope’s image or voice is not allowed outside the Vatican.
▫️ Unauthorised use must be punished by the law of the corresponding state, but it was not explained to us which state it should be. We assume that it is in the territory of the state where the violation took place and where the lawsuit was brought.
As there is no judicial practice on this unusual copyright issue, it is likely that it has more relevance to the religion than to actual law enforcement. However, it would be interesting to observe any court decisions concerning Papal copyright in the future.
