🔇"Johny Johny Yes Papa" Failed to Be Registered as a Trademark
MORA TV SRL is a Romanian company (hereinafter, the Applicant) that offers high-quality media content for children. On June 8, 2022 the Applicant filed an application for registration of a sound trademark "Johny Johny Yes Papa". The European Union Intellectual Property Office (hereinafter, the EUIPO) refused the registration on the grounds of article 7(1)(b) of the Regulation (EU) 2017/1001: trademarks which are devoid of any distinctive* character shall not be registered.
*Disclaimer: a trademark is distinctive if it identifies the goods or services for which it has been registered as coming from a particular undertaking, and thus distinguishes them from those of other undertakings.
Some of the EUIPO’s arguments are cited below:
▫️ the mark consists both of a musical and a textual part; at the same time, the musical part is found in other baby songs, and the textual part does not contain any striking or unusual sound elements;
▫️ being a simple and popular baby song with many adaptations, the mark cannot distinguish the Applicant’s goods (services) from those of other enterprises;
▫️ the mark is too long to serve as an indicator of origin.
The Applicant, among other things, has put forward the following arguments:
▪️ consumers are used to audio and video content and can easily form associations between a sound designation and goods (services) of a particular undertaking;
▪️ "Johny Johny Yes Papa" is currently the most viewed video uploaded by the Applicant to the Youtube channel, with over 6.5 billion views, meaning that the audience will automatically associate the song with the Applicant;
▪️ despite the fact that the song includes simple words, the unusual musical part makes it distinctive;
▪️ "Johny Johny Yes Papa" is firmly associated with the Applicant and is very popular: it tops the list of the most popular children's choices on Spotify, Amazon, and Apple Music.
All these arguments failed to persuade the EUIPO, and the registration of the mark was refused.
In addition, the Applicant failed to prove the acquired distinctiveness of the mark due to long and continuous use, as from the evidence presented, it was not obvious how many unique users, in which territories, and for how long had interacted with the mark. A sociological survey (which, however, was not presented) could have become such a proof.
The information about the possible appeal is not available yet and the deadline is about to expire, but we hope that the Applicant takes a chance and appeals the refusal.
