​🎬 Deepfakes and celebrities

Thanks to AI-powered software, entertainment industry has entered a new stage of development. Face transformation technologies do not only create opportunities for business, but also bring new challenges to the legal system.

Every day new trends emerge, allowing bloggers to experiment with morphing their faces, adopting virtual avatars, and exploring new looks as they engage with their viewers.

Under these circumstances, the right of publicity itself has become a valuable asset: some celebrities have chosen to license the use of their appearance, allowing the creation of deepfakes in certain cases.

While the integration of deepfakes and AI-generated characters is undoubtedly exciting, many users tend to forget about the legal implications related to intellectual property and publicity rights. As we have discussed in our podcast, copyrighted images should be respected and proper permissions should be obtained before incorporating these images into AI-generated content.

Legal issues

The use of someone's likeness, including image, voice, and even style, without consent can lead to serious legal consequences, as publicity rights are legally protected in most jurisdictions. For instance, in one case, Selena Gomez sued several companies for using her image and likeness in the mobile game "Clothing Forever" without her authorization. Another example would be face-swapping apps, which infringe upon the likeness rights of numerous famous individuals by allowing users to interact with digital representations of historical figures, celebrities, or fictional characters.

Because of these apps, new types of lawsuits “related to AI” are popping up. For example, in Kyland Young v. NeoCortext, Inc., the celebrity alleges that the deepfake-app unlawfully exploits his appearance and reputation.

The struggle for roles

Meanwhile, actors and other artists express concerns about their potential loss of employment and actively protest against the use of deepfakes in creating movie characters. As the result of the strikes, negotiations between producers and acting communities have begun, with celebrities aiming to ban the unauthorized use of their likeness.
