There is a belief that programmers are not creative. But hold on — they create literary works every day!
Computer software is protected by copyright as a «literary work» under the Berne Convention for the Protection of Literary and Artistic Works.
According to the Convention, protection is granted to a computer program from the moment of its creation and does not require compliance with any formalities such as registration or deposit of copies. This protection extends to all copyrightable expressions embodied in the program. Such regulation operates almost all over the world: the Berne Convention has been ratified by 181 states out of 195 countries.
Not everything in the garden is rosy
Automatic copyright protection activates the instant your software becomes fixed in a tangible medium. This means that no one may copy, distribute, display or make adaptations of the computer code without your permission.
Moreover, copyright protection is not limited to literal copying of the source code. In fact, the structure, sequence and organization of the computer software are also copyrightable (Oracle Am., Inc. v. Google Inc., 750 F.3d 1339, 1348 (Fed. Cir. 2014).
However, according to The Software Alliance report, unlicensed software is still being used around the globe at alarming rates, accounting for 37 percent of software use.
This encourages programmers to use special remedies to protect their computer code from copying and subsequent distribution through plagiarized developments. And while the registration does not confer any extraordinary rights, it remains a widely used instrument for developers because it helps to prove the existence of rights for their product in case of violation.
And that's how it works in some jurisdictions:
✔️European Union — deposit system with private depositories or notaries;
✔️USA — Copyright Office (the United States Copyright department of the Library of Congress);
✔️Canada — Business Development Centre;
✔️United Arab Emirates — UAE Ministry of Economy;
✔️China — China Protection Center;
✔️Japan — The Software Information Center;
✔️Australia — Australian Copyright Council;
✔️South Africa — Companies and Intellectual Property Commission (CIPC).
In short, the registration of a computer program is an available remedy (fast and inexpensive as well) from wrongful acts against your intellectual property.
