Saisie-contrefaçon! – This might well have been a magic spell practised at the Beauxbâtons magic school. Quite unromantically, it actually is a legal tool, and among the most power ones in the arsenal of French IP-lawyer. The term is, in fact, used to refer to the special pre-court procedure of obtaining proof of intellectual property infringement.

First introduced in 1793, by the revolution-born National Convention in order to protect the freshly proclaimed intellectual property rights, today (from 2007, to be precise) saisie-contrefaçon may be used for any kind of intellectual property, including trademarks, computer software and databases.

The rightsholder who claims to be a victim of a violation of intellectual property rights receives an authorisation from a judge (or the President of the tribunal de grande instance of Paris, the Tribunal Judiciaire de Paris, for EU trademarks) to enter the place of the potential infringer or of a third party, whether it is operating or not, accompanied by a bailiff.

The surprise nature of the action is a key to success. That is why the owner of the place is not warned about the visitors. In addition, the requesting party does not need to prove the infringement of rights, it is sufficient to its own intellectual property and to set up a search area.

This procedure to immediately and effectively obtain the proof of infringement of intellectual property, if, indeed, it tooks place.

The restriction of rights of the person whose place is entered is then compensated for by his right to claim that the bailiff’s intervention exceeded the extent sufficient to obtain proof, as established by the French Cassation Court (Cour de cassasion) in a 2013 precedent. In addition, the requesting party does not need to prove the infringement of rights, it is sufficient to own intellectual property and to set up a search area.

The surprise nature of the action and the strict proportionality control make saisie-contrefaçon one of the most common methods of securing proof in France.

After the proof is obtained in the way described above, the party that initiated the saisie-contrefaçon has 30 days to file a suit against the infringer.

By the way, Saisie-contrefaçon has one significant advantage: the proof collected in France in this manner (including proof in electronic format) may be used in proceedings in other jurisdictions. For example, as it was in the case of Sanofi-Aventis v. Mylan considered by the Court of Appeal of Paris.
