🤔 One more attempt to protect biometric data from AI-created representation
NO FAKES (The Nurture Originals, Foster Art, and Keep Entertainment Safe Act of 2023) is the new U.S. bill presented to prevent unauthorized copying of individuals` image, voice, visual likeness and subsequent incorporation it into a sound recording or audiovisual work.
An infringer may face a lawsuit demanding either $5,000 per violation or other compensation for damages.
By the way, the bill establishes some exclusions for such representations (similar to fair use). For example, it shall not be a violation if the applicable digital replica is used as part of a documentary, historical or biographical work. A possible case would be an interactive digital copy of Salvador Dalí based on numerous statements, photographs, and video interviews and presented at the "Dalí Lives" exhibition in Florida, dedicated to the 115th birthday of the surrealist.
Underlying reason
By a coincidental coincidence, the largest strike of actors and screenwriters in the USA ended one month ago. One of the key reasons for it was the concern over the use of artificial intelligence instead of human creative work.
Through the use of deepfake technology and CGI (computer-generated imagery), it`s become possible to produce scenes without performance of actors and bring back to life movie characters (for example, how it`s done in "Flash' (2023)).
"NO FAKES" has already been supported by Screen Actors Guild - American Federation of Television and Radio Artists.
Furthermore, disputes about the use of AI to "steal" voices are widespread (look recent case of fake tracks featuring Drake, Rihanna, Kanye West, and Justin Bieber) as well as deepfakes of celebrities in advertising.
Will "NO FAKES" solve current challenges?
The bill is primarily aimed at protecting personal identifiers. But it's worth noting that these identifiers are already protected by the right of publicity.
The right of publicity prevents the commercial use of individuals`name, likeness, and image, which is essentially what is proposed in the bill, with the additional clarification that the violation occurred using computer technologies.
