​🎼 Track leaking: endure or secure?

The British singer FKA Twigs said that 85 of her demos had been stolen. “No new music for a while”, announced FKA Twigs, to the fans’ disappointment.

Leaking of track demos is the curse of the digital epoch. Malefactors “leak” track demos to the Internet in large numbers. This is how some of the demos by Eminem, Juice WRLD, Madonna, Kanye West, Lana Del Rey, and many other singers became public before their official release.

🧐 How can singers protect themselves? And does the right to a demo actually arise?

Let us remember the basic rules of copyright protection of works which, with a few reserves, are used in many countries of the world:

🧑‍🎨 the work must be creative;
💿 the work must have a fixed material form; as long as the work is just the author’s idea, it will not be protected by copyright;
🗃 no registration is required;
📝unfinished works are protected, too.

So, does one just take their copyright to a demo and go for the malefactor? It is not that simple. In the cases of illegal access to demos, it is often not the proof of authorship, but the identification of the malefactor that is an impossible task. That is why such violations frequently remain unpunished.

Bearing this risk in mind, songwriters and other rights holders must keep ahead of the game and use only secure storage for their demos, avoid sending them by e-mail or uploading them to unverified platforms (that is, ensure as much as possible a secure storage and transfer of data). And, of course, they must properly manage their relationships with those having access to the demos: trust but execute you must! These are important steps, but even they may prove insufficient. Malefactors may be one step ahead of you.

Singers have to come up with new ways to fight against the leaking of their tracks, for instance, by making an unexpected release, ahead of the planned date or without any announcement at all.

One thing is clear: track leaking will not stop in the nearest future, because so far, no sure protection from leaks has been invented. Only digital and legal literacy can help, even though they offer no guarantees.

However, authors and rights holders should definitely not give up. First, sometimes the malefactors can be tracked down. For instance, in March 2023, the hacker who had leaked Playboi Carti’s tracks was arrested. Second, the more measures are taken and the more original they are, the higher the chance to prevent the risk of unauthorized access to demos.

After the leak, FKA Twigs posted a photo saying “I will find you” on Instagram, demonstrating her serious intentions to do it. Let us hope that she succeeds in finding the malefactor and protecting her rights.
