Now another firm presented exactly the same invention, but as a Utility Model. Has anyone had a similar case in the past or knows jurisprudence in this regard, on which we can base our Opposition. As long as in Colombia Utility Patents are subject to publicación and substantive examination, then you may file opposition, and later an appeal, if it is granted, all during the prosecution stage (before the PTO). If granting still alive, you could challenge via nullity action. In all cases, the grounds to file the opposition/appeal/nullity action will be the previous protection as a Utility Patent. However you should bear in mind that Industrial Designs only protects the physical appereance and not any other functionality, at least according to the applicable law in Colombian

I don't know the law in Uruguay but if possibile I'll suggest to challenge Utility Model validity filing nullity action.
If the Industrial Design Register by you new client shows the tecnical elements on which the Utility Model is based you can base the nullity action on the lack of novelty.
