🟪 Today, we will show you how Planet Fitness protects its interiors in the US with trademarks.
In the US, the Planet Fitness brand is protected by a total of 224 trademarks, but today we would like to focus on an unusual approach of the brand’s lawyers who protect the brand colors through positional trademarks.
Interior design is an important element of the brand identity, in particular, when the brand offers its services through points of sales. That is why creating and protecting a distinctive and recognizable interior design is a perfect solution for marketing the brand.
At the same time, registering a color is a long and costly process which, we must admit, might not be affordable for every company. Planet Fitness came up with a creative solution for protecting the colors of its interiors. Instead of registering their colors, they protected the positions of these colors in the interior, as registering a positional trademark is often much less complicated than registering a color.
In a positional trademark, elements that are not covered by protection are marked with a dotted line. If you look at the trademarks in the gallery, you will see that the brand’s lawyers actually only protect the colors of specific details of the interior. This protection, however, does not prevent the competitors from using exactly the same colors in their interiors.
