Picasso, Artist’s Intention and Start of Cancel Culture
Guernica is not only surrealistic visually as a mix of real and unconscious reflections of Picasso over horrors of modern war.
It is surrealistic ideologically as Picasso attaches to Guernica his emotional author’s Intention when and where painting can or can’t be demonstrated which on its own becomes a virtual part of Guernica and underlines its antiwar and antinationalist message.
In such Intention Picasso denies the right of conservative Francoist Spain to host Guernica on its territory till the moment nationalist regime would collapse and new democratic government would be established.
In such denial Picasso demonstrated himself as one of the founders of what later would be called a “cancel culture”, social phenomenon in which someone who acted unacceptably from author’s perspectives (e.g., Francoist Spain who overthroned previous republican government) is boycotted and denied in its right to access his/her creativity fruits.
Technically Picasso’s Intention as idealogical part of the masterpiece in its broad sense was formalized in the Loan agreement signed by the artist with MOMA where Guernica has been demonstrated till collapse of the Spanish nationalist regime and by Picasso’s Will executed by the artist’s lawyer and later French Foreign Minister Rolan Dumas.
The latter was empowered by Picasso to determine when democratic conditions denoted in the Will were met and transfer of Guernica from MOMA to Spain could be authorized.
This finally happened on September 10, 1981, after death of both Picasso and Franco, coronation of new King Juan Carlos and after democratic elections held in Spain for the first time in 40 years.
Today Guernica is demonstrated in Madrid, and since the year 2023 it is even allowed to make its photos for all the visitors.
Modern intellectual property law almost totally misses proper legal regulations to protect ideological part of a masterpiece as it was important in case of Guernica, so new proposal required to be reflected in IP Surrealism Manifesto and de lege ferenda.
On February 27, 1939 after the defeat of republicans in the battle for Catalonia France and UK officially recognized nationalist regime of Francisco Franco as legitimate government of Spain, drawing a line under 2,5 years long civil war, which technically ended several weeks later.
Guernica - a central masterpiece of Pablo Picasso named after Spanish Basque city almost totally destroyed 2 years before, portrays the devastation and suffering caused by violence and chaos of that war and serves as a bold reminder about inhumanity of any military conflict. «It was a universalized image of violence and destruction. It deals with experiences that transcend anyone: event or nation».
