Andre Masson and Non-Intentionally Created Art
Andre Masson’s Battle of Fishes is wonderful example of surrealistical automatism, artistical method where creator suppresses his or her conscious control over the process, allowing the unconscious mind, gravity and chance to have greater influence on the final result.
“To allow a more spontaneous paint flow, Masson began squeezing paint directly from the tubе…, pouring gesso onto a canvas, smearing it around, improvising with his fingers, and throwing sand onto the sticky surfaces to create a textured, earthy ground”.
While before surrealism the creative process was generally understood as strictly intentional and the artist totally predicted and desired the exact position of the graphical forms, colors and paints on the canvas, in the Battle of Fishes the creator from the very start was likely indifferent to the details of the painting and could not exactly foresee how it would finally look like.
Such artistical approach opens La boîte de Pandore for the lawyers who assess whether artwork may fall under the protection of copyright in each particular jurisdiction.
As of now the courts usually use a threshold of originality concept to protect the artwork and require “intellectual effort" from the author who must ensure that (i) creative process was not "so trivial that it could be characterized as a purely mechanical exercise”,
and that (ii) “work demonstrate a "modicum of creativity" in decision making rather than a mechanical exercise in order to be original”.
Since modern art after surrealism is no longer fully intentional, such approach may lack copyright protection for automatically created artworks or their parts.
IP Manifesto should specifically propose a new approach to the protection of artworks created non-intentionally, i.e. without human mental efforts.
Redesign of threshold of originality concept will also provide opportunity to protect in future other artworks, created without any intentional human participation, such as artworks created by animals (e.g., Naruto v. David Slater) or AI-generated artworks.
Andre Masson was among the million of soldiers wounded in the Battle of Somme (1916), one of the deadliest in WW1.
Ten years later he created his “Battle of Fishes”:
“Ripping through the water the fish on the right side darts out and bits the fish on the left. Blood pours out in a thick stream and the act is over, life slowly returns to normal. But the future does not like so promising for these fish and is symbolized by the cool colors such as blues and greens”.
It is a symbol of society after WW1 where people left apart of their community. “Most of them are distraught and stranded, but some are hurt or dead.”
