«Creativity is that marvelous capacity to grasp mutually distinct realities and draw a spark from their juxtaposition». This approach denoted once by Max Ernst was one of the principal in his art.
His “Ubu Imperator” brings several distinct realities into one masterpiece to light up such a spark.
Huge red anthropomorphic figure is raising his hands, shouting and making orders to others, being located in yellow completely deserted space where no other actors attend. His colossal Pisa-tower style head and huge torso end with thin pencil lead. Ernst is widely using collage technics to underline such contradictions.
Name of the painting is enhancing its logical contradiction, where from one side masterpiece protagonist is ranked as “Imperator”, i.e., a holder of of the highest authority among all others, but from another side refers to the screenplay of the French writer Alfred Jarry "Ubu Roi", which in its turn is a parody of Shakespeare's Macbeth, Hamlet and King Lear and where King Ubu, “the central character is notorious for his infantile engagement with his world”.
Juxtaposition between the logically contradicting graphical elements, between two words in one name as well as between the name and the painting itself - it forms a central idea of Max Ernst work. Such approach along with his several other new artistic techniques (e.g., frottage) will be revolutionary for the future art and will be widely exploited in his following masterpieces.
However, modern law never provides any mechanism to recognize or to protect such artist’s techniques till the moment they are expressed in the specific graphical or verbal form. Thus, the modern copyright is not so modern in comparison with Max Ernst works since axiologically it is the same copyright as it was during his whole life and even several decades before the artist was born.
So, it requires additional consideration in IP Surrealism Manifesto on how such recognition and protection may be denoted in future law in a well-balanced manner.
Ubu Imperator was Max Ernst’s reflection inspired by his childhood dream where he saw the painting protagonist transforming into his father (as it is mentioned in his "Visions de demi-sommeil").
At the same time the masterpiece was created just 5 years after the end of WW1, where Max Ernst had participated in actions at both Eastern and Western fronts. So, Ubu Imperator may also be inspired by the collapse of the German Imperial Power in November 1918.
“On the first of August 1914 Max Ernst died. He was reborn on the first of November 1918 as a young man who aspired to find the myths of his time” wrote famous artist later.

😮Not much.
The first Patent law was introduced by Venice in 1474, and in writing it stated three criteria for the invention to be protected. It shall be “new”, “ingenious”, and "produceable".
Contemporary regulations in many jurisdictions mandate adherence to three key criteria:
🤖 "Novelty"
An invention must be not previously known to the public. Any public disclosure before applying for a patent can compromise its novelty. However, some jurisdictions offer a grace period for disclosures that don't affect the invention's novelty.
To illustrate, installing an inventive solar panel on the inventor's roof could be considered a public disclosure that might undermine the novelty of the invention, potentially affecting its patentability.
👾 "Non-obviousness" or "Inventive Step"
An invention must be a creative solution which would not be readily apparent to someone skilled in the field.
For example, the solar panel invention that uses a non-obvious and creative mirror arrangement to focus sunlight onto a small area would meet the inventive step criterion, making it eligible for a patent.
🏭 “Utility” or “Industrial applicability”
An invention must be capable of being manufactured.
A solar panel that is too big for regular rooftops or needs materials that do not exist would not meet the requirement for being manufacturable for a patent.
