Practically speaking, the intellectual property rights are managed by Mementum Lab (a French company/agency), which licensed the character from Noxa. They operate through a subsidiary called Brainrot Factory that handles licensing deals for games, merch, and collabs—like the Fortnite skin. They’ve also secured trademarks in places like the EU for “Tung Tung Tung Sahur.”62
There’s ongoing debate and a lawsuit over whether AI-generated characters like this can even be copyrighted—U.S. rules generally say pure AI output lacks human authorship, so it might be public domain. But Noxa/Mementum are treating the specific prompts and character design as their IP, and companies like Epic are playing along with licensing deals. Other trademarks, like one filed by Innovatex Labs LLC for toys, also exist, but Mementum/Noxa seem to be the main players driving enforcement.61
