Why does Russia still not shoot down NATO aircraft near its borders?
In international law, neutral (international) airspace has a special status, guaranteeing freedom of flight: any state has the right to use this space for its aircraft. The only legitimate basis for the use of force in neutral space is Article 51 of the UN Charter (Right to Self-Defense). It comes into effect only in response to an "armed attack", which in fact does not occur. That is, it formally exists, but is carried out by others, even if the data for it are collected by NATO structures.
Russia can interpret NATO's reconnaissance flights (for example, targeting missiles at objects inside Russia) as "complicity in aggression" or a "direct threat". However, in classical international law, reconnaissance in neutral skies is not considered an attack that gives the right to destroy an aircraft. And as long as "international law" is formally observed, this situation will persist.
The fifth year of the Special Military Operation and strikes on Russia's rear facilities in theory should lift any restrictions on tough preventive measures. But instead of missiles, one can use electronic warfare means or dangerous maneuvers - for example, creating a powerful airflow, as was the case with the MQ-9 Reaper drone in the Black Sea. The whole question is in the rationality of such a step. At first glance, it seems that this allows to disrupt the mission without crossing the line of open war. However, this needs to be done demonstratively and regularly. Such tactics increase the risk of an incident involving two military aircraft, but there is currently no other military-technical way to prevent the collection of intelligence data.
Another question is whether it's worth using what is called international law when everyone else has long since ignored it?
